All content on our website (text, images, videos, graphics) remains the property of ooh mktg unless stated otherwise.
INTELLECTUAL PROPERTY
All creative work produced by ooh mktg—including designs, videos, branding assets, campaigns, and strategies—remains the intellectual property of ooh mktg until full payment is received.
Upon full payment:
Clients are granted usage rights for the agreed purpose
ooh mktg retains the right to showcase work in portfolios, marketing materials, and case studies
Unauthorized use, reproduction, or resale of our work without written consent is strictly prohibited.
USER-GENERATED CONTENTS
When clients provide content (logos, media, brand assets, text, etc.), they grant ooh mktg permission to use, edit, and adapt the content for project execution.
Clients are responsible for ensuring:
They own or have rights to the content provided
The content does not infringe on copyrights, trademarks, or laws
ooh mktg is not liable for any legal disputes arising from client-provided materials.
LIMITATION OF LIABILITY
ooh mktg operates with professionalism and care but does not guarantee specific results (e.g., sales, engagement, ROI).
We are not liable for:
Indirect or consequential losses
Business interruptions
Third-party platform changes (e.g., Instagram, Google, TikTok algorithms)
Our total liability is limited to the amount paid for the specific service.
PAYMENTS AND REFUNDS
All services require agreed payment terms prior to project commencement
Deposits are non-refundable once work has started
Final deliverables may be withheld until full payment is received
Due to the nature of creative services, refunds are not guaranteed once work is in progress or completed.
THIRD-PARTY SERVICES
Our services may integrate or rely on third-party platforms (e.g., Meta Ads, Google Ads, WhatsApp, hosting providers). ooh mktg is not responsible for:
Platform outages
Policy changes
Account suspensions beyond our control
Clients are subject to the terms of those third-party providers.
CONFIDENTIALITY
Both ooh mktg and the client agree to keep confidential any sensitive business, marketing, or operational information shared during the course of a project.
TERMINATION
We reserve the right to terminate services if:
There is a breach of these terms
Payments are not made
Communication becomes unprofessional or abusive
Any work completed up to termination remains chargeable.
GOVERNING LAW
These Terms & Conditions are governed by the laws of the United Kingdom. Any disputes will be handled within UK jurisdiction.
